What exactly is the HHSRS?

Local authorities are able to use the Housing Health and Safety Rating System or HHSRS at any time to identify health and safety hazards in your property. This could be as a result of a tenant complaint, a concern raised by another party or just as part of a proactive inspection.

The HHSRS was introduced by the Housing Act 2004. It is a risk based tool and it covers hundreds of possible property hazards within 29 overall categories.

The risks for landlords

The HHSRS classifies hazards as either category 1 or category 2. Should a category 1 hazard be found your local authority must take further action by law.

Enforcement officers are able to choose from a range of enforcement actions: They can issue notices and orders including those which prohibit the occupation of the property, impose civil penalties or take legal action. Tenants may be able to obtain a rent repayment order. Property hazards are also a leading reason for seeking landlord banning orders.
